Users may request a refund subject to the terms and conditions outlined in the policy. 16. Suspension and Termination The Wellness Empowerment Alliance reserves the right to suspend or terminate a user's access to the platform for violations of these Terms and Conditions or for any other reason, without prior notice. 17. Governing Law These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Connecticut. Any disputes shall be resolved in the state or federal courts located in Connecticut, Unites States. 18. Privacy Policy
The expectations of confidentiality between a coach and client are not the same as those in a therapist-client dynamic. Unlike professions such as medicine and law, the coach-client relationship lacks a legally recognized privilege, meaning communications are not safeguarded by confidentiality laws. In accordance with professional standards, the coach commits to respecting the confidentiality of the client, refraining from sharing any sensitive details unless explicit written permission by the client is given. Furthermore, the coach will not use the client's name as a reference without their consent. Confidential information generally excludes information that is publicly accessible, already known by the coach before disclosure, or independently created by the coach without using the client's confidential information. Moreover, information that becomes public knowledge through no fault of the coach or information obtained legitimately from a third party without any restrictions on disclosure may not be deemed confidential. Safety If there are concerns regarding your safety or well-being or if you pose a threat of harm to yourself or others, your coach will be required to contact emergency services or reach out to the designated emergency contact listed, who can assist in ensuring safety. If you communicate a threat of physical violence against your coach or a reasonably identifiable third person and you have the apparent intent and ability to carry out that threat in the foreseeable future, your coach will have to disclose information in order to take protective action such as notifying the potential victim (or her/his/their legal guardian and the county Department of Social Services), contacting the police, and/or seeking hospitalization for the client. If such a situation arises, your coach will make every effort to fully discuss it with you before taking any action. While this written summary of exceptions to confidentiality should prove helpful in informing you about potential problems, it is important that any questions or concerns that you may have now or in the future be discussed with your coach. The laws governing confidentiality can be complex, and coaches are not attorneys, therefore in situations where specific advice is required, formal legal advice may be needed. No Recording Policy In the interest of maintaining a safe and confidential environment, my policy regarding the recording of coaching sessions, whether through video or audio means are noted below: 1. No Recording Policy Recording of coaching sessions, whether through video or audio recordings, is strictly prohibited without explicit consent from both the coach and the client. 2. Confidentiality and Privacy Coaching sessions are a confidential space where clients are encouraged to express themselves openly and without fear of judgment. Recording sessions can compromise this confidentiality and infringe upon the privacy of both the client and the coach. 3. Trust and Coaching Relationship Trust is fundamental to the coaching relationship. Recording sessions without consent can undermine the trust between the coach and the client, potentially hindering progress in coaching. 4. Exceptions In certain cases, such as for coach’s purposes or for training purposes with explicit consent from both parties, recordings may be made. However, these instances will be discussed and agreed upon beforehand. 5. Legal Considerations Recording coaching sessions without consent may violate laws regarding privacy and confidentiality. Such actions may have legal consequences. By engaging in coaching sessions at The Wellness Empowerment Alliance, LLC, you acknowledge and agree to abide by this policy. Payment, Cancellation & Refund Policy
Your time is important to us, and we reserve our sessions exclusively for you. We strive to accommodate your needs and those of other clients. To ensure a smooth process, please note the following policies: Payment and Refund Policy: •Our package pricing and payment plans are clearly outlined in your chosen coaching package. We accept all major credit cards via Stripe or Square (for in person drop in’s) for your convenience. •Payment is due at the time of booking, per the chosen payment program you selected at the time of booking (e.g., payment in full, installment payments). •Methods of payment accepted are credit card •To streamline our billing process, all invoices and statements will be processed securely via Stripe or Square, ensuring your financial information remains protected. •A full refund of any advanced payments made, will be issued for written termination of coaching services received with more than 48 hours’ notice before the start of the first scheduled session. •A 50% refund of any advanced payments made, will be issued for written termination of coaching service received with less than 48 hours’ notice before the start of the first scheduled session. •Any written termination of coaching service received after services have commenced will result in forfeiture of any refund for services already rendered. A subsequent refund of 50% of any advanced payments will be made. •No refunds will be provided for cancellations received with less than 48 hours’ notice, due to reasons other than sickness or emergency. •One no show will result in forfeiture of all funds paid towards that session. •A second no show by you will result in the forfeiture of all funds paid. •Any fees paid for unused sessions will be refunded based on the “Termination, Cancellation and Attendance Policy”. •See Termination, Cancellation and Attendance Policy for additional attendance related information. Termination, Cancellation and Attendance Policy: •Written notice is required for any termination or cancellation of coaching services. •Written termination of coaching services received with more than 48 hours’ notice will be eligible for a refund of any advanced payments made (see Payment and Refund Policy). •Written termination of coaching services received with less than 48 hours’ written notice will only be eligible for a partial refund of any advanced payments made. (see Payment and Refund Policy). •Your coach reserves the right to terminate services at any time for any reason (e.g., attendance issues, lack of progress, need for higher level of care etc). All attempts will be made to discuss causes for termination of coaching services and any recommendations or referrals deemed necessary by your coach will also be discussed prior to termination of services. •In the event of a cancellation of your scheduled session by your coach, every attempt will be made to reschedule the session for the next available coaching time. •All session cancellations must be received in writing. •Any session cancellation received with more than 48 hours’ notice or due to illness or emergency, will be rescheduled for the next available coaching time. •Any session cancellations made by you, with less than 48 hours’ notice, due to reasons other than sickness or emergency will result in the session time being forfeited (see Payment and Refund Policy). •Any no show by you, for a scheduled appointment will result in forfeiture of the session time (see Payment and Refund Policy). •A second no show by you will result in a termination of all coaching services (see Payment and Refund Policy). Termination of Agreement: Either party may terminate this Agreement in writing at any time, in accordance with the aforementioned “Termination, Cancellation and Attendance Policy”.
Coaching Service Agreement
Participation in coaching can yield numerous benefits, such as improved interpersonal relationships, resolution of specific concerns, personal growth and development, accountability, motivation, enhanced problem-solving skills, increased confidence and resilience and clarity of purpose and direction. It's important to recognize that coaching requires active participation, honesty, and openness with your coach to meet your agreed upon goals. Without genuine commitment and willingness to engage in the process, the potential impact of coaching may be limited. Coaching vs therapy: Coaching: Coaching typically centers around personal or professional development, focusing on enhancing skills, achieving goals, building resilience, and maximizing potential. It is future-oriented, with an emphasis on setting and achieving objectives to improve performance or quality of life. Coaches work with clients to identify strengths, overcome obstacles, and create action plans to move forward. Coaching primarily focuses on achieving specific goals, such as career advancement, improving relationships, or enhancing leadership skills. Coaches often provide guidance and support based on their expertise in specific areas. Therapy: Therapy, on the other hand, is often more focused on mental health and emotional well-being. It addresses psychological issues, past traumas, and unresolved emotions that may be hindering a person's ability to function optimally in various areas of life. Therapists help clients explore and process their feelings, develop coping mechanisms, and gain insight into their thoughts and behaviors. Therapy delves into deeper emotional and psychological issues, often related to past experiences or trauma. Therapists, on the other hand, are trained mental health professionals, such as psychologists, psychiatrists, or licensed counselors, who specialize in diagnosing and treating mental health disorders. Agreement: · The coach commits to upholding the highest standards of ethical and professional conduct. · The client agrees to active participation, honesty, and openness with their coach to meet the agreed upon goals. · The client is accountable for all decisions concerning their emotional, mental, and physical well-being while engaging in coaching services. · The coach assumes no liability or responsibility for any actions taken or not taken by the client or resulting consequences stemming from the services provided. · The client recognizes and acknowledges the understanding that coaching is not therapy and if it is recognized that your needs may extend beyond the scope of coaching and require specialized mental health support, your coach will make every effort to provide referrals to qualified mental health professionals in your area to ensure you receive the appropriate level of care. · The client recognizes their right to cease coaching services and understands that by doing so, any payments already made for services rendered will handled per The Wellness Empowerment Alliance’s refund policy. The client recognizes that in failure to adhere to this agreement, it is the coach’s prerogative to discontinue services, with no refunds being made for any payments already rendered.
